PRIVACY POLICY

In accordance with Article 19 Nº 4 of Chile’s Political Constitution and the relevant norms of Law Nº 19.628 on the protection of privacy and its subsequent modifications, the treatment of personal data by the Foreign Investment Committee’s website www.doingbusinessinchile.cl is governed by the following rules:

• The Foreign Investment Committee guarantees the confidentiality of the personal data of users who register as such on the website www.doingbusinessinchile.cl by completing one or more of the forms supplied for this purpose. Notwithstanding its legal powers, the Foreign Investment Committee will only process personal data provided voluntarily by users in the said form.

• Users’ personal data will be used for the purposes indicated in the corresponding form and always within the bounds of the responsibilities and powers of the Foreign Investment Committee.

• In accordance with the terms of Law 19.628, the Foreign Investment Committee may make the personal data of its users available to other State entities.

• If so required by the courts, the Foreign Investment Committee will make available the personal data of its users as requested.

• Statistics generated on the basis of users’ personal data may be made available to third parties by the Foreign Investment Committee without the express consent of the user, providing that these statistics do not permit the identification of individual users, as established by the Law.

• The user may at any time exercise the rights established by Law Nº 19.628 and its subsequent modifications. Specifically, the user may:

a. Request information about the data bank for which the entity is responsible, the legal grounds for its existence, its purpose, the type of data stored and description of the universe of people included;

b. Request information about the data relating to the user, its source and destination, the purpose of its storage, and the identity of the people or entities to whom this data is regularly transmitted;

c. Request the modification of the user’s personal data when this is incorrect or out-of-date, if this is within the bounds of the law;

d. Request the elimination or cancellation of the data provided when the user so wishes, if this is within the bounds of the law;

e. Request in accordance with Law 19.628 a copy of the corresponding part of the modified register, if this is relevant.

• In order to exercise these rights, the user should contact chileinvestment@cinver.cl, clearly stating the request.

• If no response to the above communication is received within the legally established period, the user may initiate the corresponding legal actions, according to the procedure established in the Law.

• In the case of data gathered and processed automatically in order to generate registers of the activities of visitors and of audience, the Foreign Investment Committee may only use this information to prepare reports that fulfill these objectives. In no case may the Committee carry out operations that imply associating the said information to any identified or identifiable user.

• For the purposes of the present “Privacy Policy”, the user is understood to be a person who registers voluntarily on www.doingbusinessinchile.cl, using the forms provided especially for this objective, while a Visitor is a person who freely accesses the information available on www.doingbusinessinchile.cl without the need for prior registration.
